The legal proceedings took a new turn when Ebert’s attorney raised concerns about his competency, prompting a strong reaction from the musician.

“Brady Ebert, a former guitarist of the Baltimore hardcore band Turnstile who’s accused of hitting the singer’s father with a car, repeatedly professed his innocence Thursday after his attorney raised questions about his ability to understand the charges against him and assist in his own defense,” the report stated.

During the hearing, Ebert expressed disagreement with his legal representation and the allegations against him.

“Ebert’s attorney, Mark Sobel, said during a hearing in Montgomery County Circuit Court he had ‘significant concerns regarding competency.’ But Ebert stated he was ‘perfectly competent’ and declared ‘every part of the police report is a lie.’ He said he believed his attorney was working with prosecutors. Ebert also suggested that his previous lawyer might have accepted a bribe. ‘Sir, you have a very good attorney,’ Circuit Judge Eric Johnson said. ‘No, he’s not,’ Ebert said. ‘I’m going to fire him.’”

Ebert also maintained his innocence regarding the incident and expressed his intention to take legal action against those involved in his prosecution.

“Ebert said he’s been incarcerated for five months and should never have been arrested. He appeared in court in a green jumpsuit. ‘We can watch the video right now and prove my innocence,’ he said. ‘I did not commit a crime.’ He said he will be pressing charges against the police officers, prosecutors and defense attorneys in the case. Johnson then ordered Ebert to undergo a competency evaluation and scheduled another hearing for Sept. 22.”

The case stems from an alleged vehicle assault in Silver Spring earlier this year.

The incident occurred on March 29, 2026, after an argument in a driveway. Police said Ebert struck his neighbor with a vehicle, leaving the man with serious injuries, including a broken leg.

The victim was identified in subsequent reporting as William Yates, the father of Turnstile singer Brendan Yates. Ebert initially faced charges including attempted second-degree murder and first-degree assault.

The charges were later escalated. Prosecutors elevated the attempted murder charge to attempted first-degree murder and added further assault-related counts.

Ebert was a founding member of Turnstile and was involved with the band during its early years. Ebert and Brendan Yates grew up near each other in Montgomery County. Ebert later left the band before his arrest.

Turnstile addressed the case in a public statement after Ebert’s arrest. The band said Ebert “went to the house of Brendan’s parents” and used his vehicle to strike Brendan’s father. The band also said it was grateful that Yates survived and received surgery.

Following the hearing, Judge Eric Johnson ordered Ebert to undergo a competency evaluation. His next hearing is scheduled for Sept. 22.
